General Terms of Sale – CGV – 2020

VEHICULES SERVICES WITH DRIVERS – BREIZHCAB LIMOUSINE – RENNES and NANTES


Art.1 CONDITIONS AND ACCEPTANCE

The customer acknowledges that he was aware of the General Terms of Sale at the time of booking.


ART.2: OFFERS

Our offers are made without commitment on our part, the booking is effective after we accept the application.


ART.3.1: RESERVATIONS

Bookings made less than 24 hours before the vehicle’s agreed departure time can only be communicated by phone, and validated by email. Acceptance depends on availability at the time of booking.

All bookings are considered confirmed only upon receipt of a dated and signed quote, and a down payment of 30 of the total amount of service requested has been made for services in excess of 100 euros TTC (except for the customers in account). For intervening services within 8 days, a bank card will be requested as a guarantee.

Making a reservation (via the online booking form, e-mail, phone call or SMS) brings full membership and acceptance of these Vente General Conditions, which you expressly acknowledge. As such, you do not have to avail yourself of any contradictory documents.

Breizhcab Limousine reserves the possibility to modify all or part of the CGVs at any time. You are therefore invited to regularly read the CGVs which are permanently.

If you do not accept CGVs, you agree not to use the services of Breizhcab Limousine.

The applicable GVCs are those in effect on the booking validation date.

Each booking must include at least:

  • The name of the reference client
  • His mobile phone number
  • The exact address or place of care
  • The final drop-off address
  • The date and time the train/flight is picked up or arrived;
  • The number of passengers
  • The list of passengers for any transport with a 9-seater vehicle
  • The number of bags
  • any other useful information, such as the need for a child seat, the presence of large suitcases, an animal, or other.

A Booking Confirmation, email and/or confirmation SMS will be sent to you to validate your booking. If you do not receive this confirmation it means that it has not been saved. In this case, contact your usual contact.


ART.3.2: ONLINE RESERVATIONS

Making a reservation via the online booking form on the website www.breizhcab-limousine.com brings full membership and acceptance of these CGVs, which you expressly acknowledge, including Article 5 and Article 6. As such, you do not have to avail yourself of any contradictory documents.


ART.4: RATES

Our rates are available on request by email, by phone (contact@breizhcab.com and 02.99.83.53.33) and via our online quote application form.

Advertised rates are indicated based on the type of vehicle used, the date and time of delivery, and any additional options chosen. Rates can be changed at any time without notice, unless a quote has been previously established.

Quotes are valid depending on our availability on the date the customer signs.

Our rates include:

  • Passenger transport and their luggage;
  • The transport of animals, in their transport box only;
  • The provision of one or more baby or child seats upon prior request;
  • Wi-Fi for all passengers;
  • Fuel costs;
  • Unlimited insurance for passengers and their luggage.

ART.5: BENEFITS

Customers are required to follow the arrival and departure procedures outlined in their booking confirmation and the procedures described on this page. If one of the procedures is not followed by the customer and has the effect of preventing the vehicle from leaving under the agreed conditions, the service will be fully due.

The customer must be ready, and on time, on the date and location agreed with Breizhcab Limousine for the departure of the vehicle.

In the event of the client’s absence at the time of the transfer, and without any demonstration on his part within the following time, after the expected time, the transfer will be billed in full:

  • 45-minute free wait at Rennes Station and Airport (public flight) – The customer will have previously informed Breizhcab Limousine of the number of the train or plane for the follow-up of the delay and its organisation, if not the following point;
  • 15 minutes of free waiting departing from any other place,and at Rennes Airport as part of a private flight, beyond: 15HT per quarter of an hour started beyond 15 minutes.

Once the waiting time has passed, the driver will try to reach the customer using the phone number that will have been transmitted by the referring customer. If he manages to reach the customer and the customer agrees to pay extra, the driver will wait on site until the customer arrives, otherwise the driver will leave the location and the service will be fully due.

In order to take care of the customer in the best conditions, it is essential to communicate all the information of the booking (train/flight number, full customer name referent, number of passengers, number of bags, date and time, and mobile phone number of the reference customer), and stay at the rendezvous point until the driver arrives and/or calls the customer.
If the customer provides false or missing booking information (including additional or oversized baggage, an incorrect or incomplete phone number, or no phone number) at the time of booking, no refund will be granted.

The driver has many reservations scheduled for the day and can only wait for the free waiting time shown above, which is why Breizhcab Limousine cannot guarantee the refund of the service if the customer is not at the appointment point at the agreed time, if he takes another means of transport, or if no phone number of the passenger (s) has been communicated.

The driver’s phone number can be provided to the customer if requested by email or phone less than 48 hours before the scheduled departure.

In the event that the customer who has booked and/or paid for a service does not show up at the place and time he has indicated himself, so that the carrier is unable to provide support, Breizhcab Limousine will not be liable, no refund or compensation will be due, and/or the benefit is due to him in full.

Breizhcab Limousine reserves the right to refuse a race if one or more of the persons transported is intoxicated, under the influence of drugs, or whose agitated and/or violent behaviour may adversely affect the safety of the transported persons and/or the driver.


ART.6: MODIFICATION

Any booking changes made by the customer must be e-mailed to Breizhcab Limousine at least 24 hours before the date and time of service. After this time, changes are only possible by phone. In all cases, changes can only be made within availability limits. If the alternatives offered by Breizhcab Limousine are rejected by the customer, the customer will have the choice between maintaining the original booking or cancelling according to the conditions below.

In the event of cancellation of the booking on the part of the customer, Breizhcab Limousine will withhold a cancellation fee based on the total TTC amount.

Cancellations and changes must be made by email and the booking number must be provided.

CANCELLATION CONDITIONS FOR INDIVIDUALS

For transfers < 250 km for a service in VL (Car or Van):

– 24 hours: 80 held
– 48 hours: 30 withheld (down payment)
7 days: cancellation free of charge

For transfers ≥ 250 km and made available hourly in VL, and for all service in PL (Minibus, Minicar or Coach):

– 10 days: 80 retained
– 60 days: 30 withheld (down payment)
60 days: cancellation without charge

CANCELLATION CONDITIONS FOR PROFESSIONALS

For transfers < 250 km for a service in VL (Car or Van):

– 24 hours: 80 held
– 7 days: 30 withheld (down payment)
7 days: cancellation free of charge

For transfers – 250 km and made available hourly in VL, and for all service in PL (Minibus, Minicar or Coach):

– 10 days: 80 retained
– 60 days: 30 withheld (down payment)
60 days: cancellation without charge


ART.7: PAYMENT

ART.7.1: PRICE

The price of the services is that of the rate in effect at the time of the order, according to the estimate previously drawn up by Breizhcab Limousine, signed and therefore accepted by the customer.

ART.7.2: PAYMENT DELAY
ART.7.2.1: PROFESSIONALS

The professional customer is obliged to pay the service within 30 days of receiving the invoice.

Down payment: A minimum down payment of 30 is required to validate any orders of more than 100 euros (except customer in account). The customer also has the option to pay for the entire service before the service starts.

A Receipt of invoice: Invoices are payable in cash upon receipt of invoice (unless stipulated to the contrary) net of instalments already paid.

Early settlement: The professional customer can also pay for his service before the start of the service, by bank transfer, online bank card or by cheque by post if the delays between payment and the start of the service allow. For a credit card payment, the transaction is immediately debited to the customer’s credit card after checking the customer’s data, upon receipt of the debit authorization from the company issuing the bank card you are using.

Discount for early settlement: 0

Legal settlement time: 30 days at invoice receipt.

Any amount not paid on its due date will produce, as of right and without prior notice, late interest three times the legal interest rate, as well as a lump sum payment of 40 euros. (Article L441-6 amended by Law No. 2010-853 of July 23, 2010 – s. 35 and Decree 2012-1115 of October 9, 2012).

If the collection costs set out by Breizhcab Limousine are greater than the amount of this lump sum, it may seek additional compensation, on justification. The file can be transferred to a judicial officer supplemented by the documents justifying the client’s order.

ART.7.2.2: INDIVIDUALS

Down payment: A minimum down payment of 30 is required to validate any orders of more than 100 euros (except customer in account). The customer also has the option to pay for the entire service before the service starts.

Cash settlement: The individual customer is obliged to pay the service no later than the day of the service (except for the event).

Early settlement: The individual customer can also pay for his service before the start of the service, by bank transfer, online bank card. Payments by cheque are no longer accepted (except event). For a credit card payment, the transaction is immediately debited to the customer’s credit card after checking the customer’s data, upon receipt of the debit authorization from the company issuing the bank card you are using.

Discount for early settlement: 0.

In the event of a late payment on the part of the individual customer, late penalties, corresponding to a percentage of the TTC amount owed by the latter, will be automatically and in full acquired at Breizhcab Limousine from the day after the due date of the invoice, without any formalities or prior notice. These late penalties will be calculated on the basis of an annual rate equal to three times the legal interest rate. The file can be transferred to a judicial officer supplemented by the documents justifying the client’s order.

ART.7.3: TYPE OF SETTLEMENT ACCEPTED

The accepted payments are:

  • Bank cards (CB, Visa, Mastercard and American Express);
  • Distance sale (VAD) by credit card;
  • Secure online payment (CB, Visa, Mastercard and American Express);
  • Bank transfer;
  • Check;
  • Species.

Cash: Beware: our drivers have very little cash on board the vehicles, please do the extra.

Check: No cheque payments will be accepted, except for local account companies billed at the end of the month, and individuals at events.

Bank card: By disclosing your credit card information, you allow Breizhcab Limousine to charge your credit card for the amount corresponding to the Total TTC. As such, you declare that you have the debit card and that the name on the card is actually yours.

At no time can Breizhcab Limousine access and/or retain your banking data, except with prior customer approval.


ART.8: PEOPLE A MOBILITY REDUCED

Breizhcab Limousine provides its best efforts to support people with reduced mobility.

Persons with reduced mobility travelling in folding and transportable wheelchairs by one person are cared for in Breizhcab Limousine vehicles.

People with reduced mobility whose transport requires suitable means (e.g. vehicle with loading ramp) can approach the Breizhcab Limousine team to study their application. If possible, a solution may be proposed to them.

Guide dogs are welcome in all Breizhcab Limousine vehicles.


ART.9: COMPUTER SCIENCE AND LIBERTES

The parties to the contracts declare that they comply with the obligations laid down by the current regulations on the production of personal data, including Law 78-17 of January 6, 1978; 6 August 2004.


ART.10 CUSTOMER ACCEPTANCE

These General Terms of Sale are expressly approved and accepted by the customer who declares and acknowledges that he has full knowledge of them, and therefore renounces to avail himself of any contradictory documents and, in particular, his own terms and conditions of purchase.
